PicTake — Terms of Service

1. Acceptance of Terms
By downloading, installing, or using PicTake ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. Our collection and use of personal information is described in our Privacy Policy.
2. Eligibility
You must be at least 13 years of age to use PicTake. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent.
3. Description of Service
PicTake is an AI-powered messaging application that allows users to communicate through AI-generated images, photos taken within the App, and images uploaded from their device gallery. Users provide text prompts and the App generates corresponding images that are sent as messages. Recipients can attempt to guess the meaning of images through a hot/cold guessing game, or reveal the original text prompt. Message delivery status is indicated by checkmarks: one gray checkmark (message not delivered), two gray checkmarks (delivered but not viewed), two blue checkmarks (viewed), two red checkmarks (hint revealed), two green checkmarks (correctly guessed).
If you grant contacts permission, the App may help you see which people from your address book already use PicTake and allow you to send invitations to others. Contact matching is performed on your device. Invites are sent only when you choose to send them.
4. User Accounts
To use PicTake, you must register using your phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information during registration. Creating multiple accounts to circumvent generation limits is strictly prohibited and will result in permanent suspension.
5. Acceptable Use
You agree not to use PicTake to:
- Generate or send illegal, harmful, threatening, abusive, or obscene content
- Harass, stalk, or harm other users
- Generate content involving minors in any inappropriate manner
- Spam, bulk-message, or send unsolicited invites or messages to contacts or other users
- Violate any applicable laws or regulations
- Attempt to reverse engineer or compromise the App's security
- Create multiple accounts to bypass generation limits
You are responsible for the invitations you choose to send and for complying with applicable messaging and privacy laws.
6. AI-Generated Content
PicTake uses third-party AI services including Replicate to generate images based on your text prompts. You acknowledge that AI-generated content may be unpredictable and PicTake does not guarantee the accuracy or appropriateness of generated images. You are responsible for the prompts you submit.
7. Payments and Subscriptions
PicTake offers in-app purchases and subscription plans processed through Apple App Store. All payments are subject to Apple's payment terms. Subscription fees are charged on a recurring basis and will automatically renew unless cancelled. Refunds are handled according to Apple App Store policies.
8. Intellectual Property
PicTake and its original content, features, and functionality are protected by international copyright and other intellectual property laws.
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms without prior notice.
10. Limitation of Liability
PicTake is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PicTake shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States.
12. Changes to Terms
We reserve the right to modify these Terms at any time and to introduce new features subject to updated Terms. Continued use of the App after changes constitutes acceptance.
